For all registrations and renewals, the Department is required to provide the name and telephone numbers of Registered HCAs who do not opt-out of this requirement to labor organizations when the labor organization asks for the information. This means that if you do not opt-out of this requirement, your full name and any telephone numbers on file with the Department may be released to a labor organization. Such penalty fee shall not exceed the amount of the renewal fee. In the case of any renewal fee which shall exceed Ten Thousand Dollars ($10,000.00), the penalty fee shall be one and one-half percent (1.5%) per month of the outstanding balance of the renewal fee.
The Board may promulgate rules which prohibit the renewal of a license or permit which has expired by more than ninety days. The law states that the labor organization can only use your information for employee organizing, representation, and assistance activities and it also states that the labor organization cannot disclose your information to any other party. However, the Department has no authority over labor organizations or control over what they do with the information. Exemptions are available only on the basis of religious beliefs or qualifying medical reasons, and exempted individuals must undergo weekly testing. Affiliated Home Care Aides must provide their Home Care Organizations with proof of vaccination or exemption and testing results, and Independent Home Care Aides must maintain their own vaccination records or exemption and testing results. Under Oklahoma law, as long as your renewal application and fee are received before it is 30 days past due your renewal will be processed without penalty and your certification remains in good standing.

How to Become a Nurse Aide I
A Home Care Aide may apply as an independent Home Care Aide initially and the Home Care Organization may request a transfer of the Home Care Aide’s clearance or criminal record exemption once the Home Care Aide is registered on the Home Care Aide Registry. A home health aide is a person working for a home health agency or hospice that performs home health services ordered by a licensed physician, licensed chiropractor, licensed podiatrist, or licensed optometrist. The home health aide must successfully complete a home health agency's competency evaluation. Home Health Agencies and Hospices are responsible for establishing their own policies on qualifications and needed training. State government does not certify training sites or the syllabus of each individual agency or organization under contract to provide training services.
A criminal record exemption is a CDSS-authorized written document that "exempts" the individual from the requirement of having a criminal record clearance. An individual must be removed from the registry in accordance with federal regulations and must retake a state-approved nurse aide training course and competency examination. An individual must apply as a new initial certification. Nurse aides that have been found to have abused or misappropriated the property of a resident will be revoked on the nurse aide registry permanently and the finding will be permanently listed on the registry. A graduate nurse aide awaiting an exam from Headmaster can work in a facility as a temporary nurse aide for up to four months if they have graduated from a state permitted nurse aide training program.
Instructions for "Verify a Nurse Aide is on the Registry"
An individual under the age of 18 may be employed as a nurse aide in a nursing home or health care facility provided employment is compliant with the Youth Employment Standards Act, 1978 Public Act 90. Of special note, under the general duty clause of the act, minors under the age of 16 years may not be exposed to communicable or contagious diseases, bloodborne pathogens, AIDS, HIV, or hepatitis. Minors aged years may work where exposure to bloodborne pathogens is likely provided the employer is compliant with MIOSHA Standard 554. Exempt minors as listed in question 19 of Michigan Wage and Hour’s FAQs are an exception.
